SIA "Montessori Solution", registration no. 40203460313, with its registered address at Jasmuižas iela 22-14, Rīga, LV-1021, hereinafter referred to as the online store, provides the content available on this website and supplies goods and/or services in accordance with the Terms of Use outlined below.

  1. General terms

When a consumer purchases goods through this website, such a mutual agreement is considered a distance contract and is governed by the laws of the Republic of Latvia, including, but not limited to, the Consumer Rights Protection Law and the Regulations of the Cabinet of Ministers of the Republic of Latvia on Distance Contracts.

The Seller undertakes to sell and deliver goods to the Buyer in accordance with the Buyer's order

  1. Making purchases

The prices and specifications of goods sold in the online store are indicated next to each product.

The Buyer places an order through this website by adding the desired goods to the shopping cart and specifying the quantity. All required fields must be completed, and the most suitable delivery method must be selected.

To complete the order, the Buyer must make the payment using the payment methods integrated into the online store or by paying the invoice prepared by the Seller and sent to the Buyer via e-mail. The invoice is issued electronically and is valid without a signature.

  1. Payment rules

The settlement currency on this website is the Swedish krona (SEK).

Payment for purchases can be made using the payment methods provided by the platform mozello.lv of the licensed payment institution Maksekeskus AS, through which the personal data required for processing payments is transferred securely.

Available payment methods include:

  • Latvian, Estonian, Lithuanian internet banking payments: Swedbank, SEB, Citadele and Luminor
  • Visa and Mastercard card payments

The contract between the Buyer and the online store comes into force upon successful payment to the online store’s bank account. If, for any reason, it is impossible to fulfill the order, the Buyer will be informed, and the paid amount will be refunded as soon as possible, but no later than 14 days after receiving the notification.

  1. Terms of delivery

Goods are delivered by courier or collected from the store to the following countries: Latvia, Estonia, Lithuania, Sweden, and other EU countries.

All duties, taxes, and customs charges required to receive the shipment at the delivery destination are the responsibility of the Buyer. Delivery costs are displayed before the order is confirmed.

Purchased goods are delivered to the address specified by the Buyer within 2–10 business days (depending on the destination country) from the moment the order is completed. In exceptional cases, the Seller reserves the right to deliver the goods within up to 45 calendar days after informing the customer.

Most goods are manufactured to order, therefore the delivery time may also be affected by production time, about which the customer will be informed individually.

  1. Right of withdrawal

The Buyer has the right to withdraw from the purchase of goods within 14 calendar days from the date of receipt of the goods. This right does not apply if the Buyer is a legal entity or if the goods have been made specifically for the Buyer according to an individual order. 

To exercise this right, the Buyer must contact the online store at [email protected] within 14 days of receiving the goods to obtain a withdrawal form. The form must be completed and returned to the online store.

The Buyer is responsible for the costs of returning the goods, except in cases where the reason for the return is that the goods do not match the order (for example, incorrect or damaged goods). The Buyer must return the goods to the Seller without delay, and no later than 14 days after sending the completed withdrawal form. 

After receiving the returned goods, the online store shall refund all payments received from the Buyer under the Distance Contract immediately, but no later than within 14 days.

During the 14-day withdrawal period, goods may only be used for their intended purpose. The Buyer is responsible for maintaining the quality and safety of the goods (Section 12, part six of the Consumer Rights Protection Law of the Republic of Latvia).

The Seller reserves the right to refuse withdrawal or withhold reimbursement if the goods are damaged, carelessly used, the instructions were not followed, or if the original packaging is lost or significantly damaged.

The Seller may withhold reimbursement until it has received confirmation of the return of the goods. If the Buyer chooses a shipping method other than the cheapest option offered by the online store, the Seller is not obliged to compensate for additional shipping costs. Refunds are processed within 5–10 business days to the bank account specified by the Buyer.

The online store is not responsible for delays or non-fulfillment caused by circumstances beyond its reasonable control.

The online store reserves the right to refuse sale or demand the return of goods if the price indicated on the website is significantly lower than the market price due to an error.

  1. Consumer rights for non-conforming goods

The online store is responsible for goods that do not conform to the contract or for defects that occurred within 6 months from the date of delivery to the Buyer, or that were present at the time of delivery, provided that such an assumption does not contradict the nature of the goods or the defect. 

The Buyer must inform the Seller of any non-conformity immediately, and no later than 2 months after detecting the defect, by submitting a complaint. Complaints can be filed by contacting the online store via  [email protected].

The online store is not responsible for defects that occur after delivery to the Buyer. If the purchased goods are defective due to the Seller’s responsibility, the Buyer has the right to request either the repair of the goods or an exchange for new goods free of charge.

If it is not possible to repair or replace the goods, the Seller will refund the Buyer all payments made under the Distance Agreement. The Seller will provide a written response to the Buyer’s complaint within 15 days.

  1. Data processing

The online store processes only the personal data provided by the Buyer when ordering goods, such as name, surname, e-mail address, and other information required to complete the order. By providing this information, the Buyer agrees that notifications related to the processing of the order may be sent to the specified e-mail address. 

The Buyer also confirms that they have read and agree that the data provided will be used to allow the Seller to accept the Buyer’s order and deliver the goods in accordance with the laws of the Republic of Latvia. The online store may transfer personal data to transport service providers to ensure the delivery of goods.

If the Buyer has expressly consented to receive marketing communications, including news and promotional offers, the online store may contact the Buyer using the provided e-mail address. The Buyer can withdraw consent and opt out of marketing communications at any time by contacting the online store at [email protected] .

  1. Dispute resolution procedure

For matters not covered by these Terms and Conditions, the Buyer and the Seller agree to comply with the laws of the Republic of Latvia

Disputes between the Seller and the Buyer should first be resolved through mutual negotiations or correspondence. If a dispute cannot be resolved in this manner, the Parties agree to resolve it in accordance with the applicable legislation of the Republic of Latvia.
